Had withdrawn from the case after Modi justified the encounter in poll speeches Senior Supreme Court advocate K T S Tulsi will appear for the CBI in the Sohrabuddin Sheikh fake encounter case.Tulsi was incidentally the Gujarat government's counsel in the Sohrabuddin case, but had withdrawn from it in December 2007 after Chief Minister Narendra Modi justified Sohrabuddin's encounter in his speeches during campaign for Assembly polls. Tulsi had also sought Modi's apologies.Tulsi, however, maintained the issue of conflict of interest will not arise in the case which has been investigated by two different agencies. "Two agencies — state police and CBI — was involved in the investigation and the fact remains that the encounter was fake," he said."If CBI feels that there is no conflict of interest, then there is no problem," he added. There were efforts by the Gujarat government officials to prevent Tulsi from withdrawing from the case, which was being heard at that time in the Supreme Court on the issue of handing over the investigation to the CBI.In his poll speeches, Modi had said he

was proud that Sohrabuddin was killed in Gujarat and if the Congress felt as bad, it should offer a chadar at Sohrabuddin's grave. An additional solicitor general would also appear on behalf of the CBI for which a notification will be issued shortly, official sources said.
Ram Jethmalan is assisting former minister Amit Shah's counsel in the case.
